DAP MP Charles Santiago says both Selangor and Penang have ongoing court cases on the validity of the EC’s report.
KUALA LUMPUR: Klang MP Charles Santiago today called on Dewan Rakyat Speaker Pandikar Amin Mulia to withdraw the Election Commission’s (EC) redelineation report before it is debated in Parliament as it is currently being argued in court.
“I remind Pandikar that he would be violating the rule of law and going against the Federal Constitution if he allows it for debate,” he said at a press conference at the Parliament building here today.
Noting that both the Selangor and Penang state governments have ongoing court cases concerning the validity of the report, Santiago said the courts must be allowed to make a decision before the report becomes a valid document.
Only then can it be submitted to the prime minister, he added.
In spite of the constitutional requirement, he said, the EC had yet to investigate the 107 notices of objection filed by Selangor voters against its second proposal in mid-January this year.
He also pointed to Pandikar’s earlier decision to rule that 1MDB could not be discussed in Parliament as it would be sub judice.
“The EC has therefore jumped the gun, and Pandikar is clearly aware of this as he made a decision last year that Parliament could not debate any cases that are being heard in the courts.
“Because of this, the distribution of the report to MPs last week was a violation of the requirements. It is clear that the report is being bulldozed through Parliament as the new boundaries benefit Barisan Nasional.”
Serdang MP Ong Kian Ming meanwhile agreed that it would be a clear case of sub judice if the report was debated in Parliament.
“For instance, Penang Chief Minister Lim Guan Eng would not be able to debate the report in Parliament as it would be part of his court case against the EC as well.
“It makes the whole debate a mockery.”
