PUTRAJAYA: The Election Commission has advised PKR vice-president Tian Chua to file an election petition to determine his eligibility to contest in a general election.
Tian Chua’s nomination as Batu candidate was rejected by the returning officer this morning.
Election Commission chairman Mohd Hashim Abdullah said the decision to accept or reject a nomination rested solely on the discretion of the returning officer at the nomination centre.
“Tian Chua can now submit a petition with the courts and let them decide on this matter. We will abide by the court’s ruling,” Hashim told reporters at EC headquarters.
Hashim said Tian Chua could not be ruled out just yet as it would depend on the Election Court’s decision.
Tian Chua had sought to file his papers to campaign for a third term as MP for Batu. His nomination was rejected because he had been fined more than RM2,000 on a charge of insulting a policeman. The fine was reduced to RM2,000 after he appealed to the High Court. The Federal Constitution disqualifies anyone fined more than RM2,000 from standing for election.
Hashim was also asked about Dr Streram Sinnasamy, another PKR candidate, who was not allowed to submit his nomination papers in the Rembau state seat.
Hashim said he was awaiting a report as he could not comment on “mere allegations”.
“If he is unhappy, they can also file a petition,” Hashim said.
It was reported that Streram was denied entry into the nomination centre because he did not have an EC-issued candidate pass. His proposer and seconder were also denied entry as they too did not have the relevant passes.
